Details for all entries located in Greece on 25 September 2020 for the year 2019 and by the end of September for the year 2018 will be transmitted by the Airbnb platform to AADE. In this context, Airbnb informed its partners that it will disclose the following information to AADE for tax purposes., as requested:
- The passport number (if available) of the host
- The name of the host (or the company name)
- The date of birth of the host (if available)
- Email address and phone number (if available) of the host
- The URL of the entries, the type of property (detached house / apartment building / other, if available) and their address
- Gross real estate income, including the supply of the platform, received the 2018 and 2019 (also, if available, payment methods, the payment account and payment service provider).
It is estimated that until the outbreak of the pandemic more than 80.000 Accommodation was rented as Airbnb in Greece
The fines for Airbnb
With the new provisions which were passed at the end 2019 and is now active the Tax Administration has the ability to request within the deadline, by written or electronic request, from any digital platform administrator, which operates in the sharing economy, regardless of whether it has a permanent establishment in Greece or not any information or data about persons who use the platform as sellers, for which tax liabilities arise or may arise in the country.
hereafter, internet service providers (ISPs) and each digital platform operator must report to the Independent Public Revenue Authority, in the manner and at the time it specifies, any information in their possession, in particular concerning persons, which are owned, the use and / or responsibility for the operation and / or management of the websites / domain names of the above digital platforms.
Shutdown on all non-cooperating platforms
Failure to provide information or data from digital sharing platforms is punishable by 30.000 until 100.000 for your internet service provider. Other persons may be fined by 5.000 until 30.000 for breach of their obligation to provide information to AADE. The threat of shutdown is estimated to be even stronger than the fines.
The provisions in force provide that non-response to the request for information within the prescribed period entails, stopping access to digital platform sites, by Internet Service Providers with registered office or place of effective administration or permanent establishment in Greece as defined in article 6 of law 4172/2013 (ITC) or in the provisions of the SADF concluded by Greece, when accessed by an Internet Protocol Address (IP address) located in Greece.
In simple words, the platform "goes down" while the Tax Administration can publish on its website a list of digital platforms on which such sanctions have been imposed.
